SPECTER, LEAHY INTRODUCE BILL TO "RESTORE" HABEAS CORPUS
In another sign of shifting ground in the post-election Congress,
Senators Arlen Specter and Patrick Leahy yesterday introduced the
"Habeas Corpus Restoration Act of 2006," which would reinstate
federal court jurisdiction over Guantanamo detainees and other
suspected enemy combatants.
The bill would repeal two provisions of the Military Commissions
Act of 2006 enacted in September that limit habeas corpus.
"Habeas corpus" refers to the ability of a detainee to seek
judicial review of his case.
"The Constitution of the United States is explicit that habeas
corpus may be suspended only in time of rebellion or invasion,"
observed Sen. Specter. "We are suffering neither of those
alternatives at the present time. We have not been invaded, and
there has not been a rebellion."
"This bill would restore the great writ of habeas corpus, a
cornerstone of American liberty for hundreds of years that
Congress and the President rolled back in an unprecedented and
unnecessary way with September's Military Commissions Act," said
Senator Leahy.

how about a bill to overturn John Warner Defense Act, assholes!
we also need to head off imminent Martial Law declaration by the dictator. How about a bill to get rid of or 'nullify' the John Warner Defense Act, which gives the dictator the power to use the military against those of us who disagree with the fascism and the war-mongering and the genocide and mass murder???

The U.S. Constitution [Art 1 Sect 7] requires the President to sign or veto any legislation placed on his desk within ten days (not including Sundays). If he does not, then it becomes law by default. The one exception to this rule is if Congress adjourns before the ten days are up. In such a case, the bill does not become law; it is effectively, if not actually, vetoed. Ignoring legislation, or “putting a bill in one’s pocket” until Congress adjourns is thus called a pocket veto.
Congress passed 6166 (Military Commissions Act 2006) on September 29th, presented it to the President on October 10th, and adjourned on October 13th. Bush signed it on October 17th, the week after Congress had adjourned, thereby rendering it “vetoed” by constitutional standards. link
Anytime Specter voices
outrage or opposition to something the Admin have done or are about to do I brace myself for another Dog and Pony Show. Too many times he (Specter) has said all the right thing but when it comes to voting he folds and joins the others to make sure whatever they are pushing gets through. Why did Specter vote for this bill and against most of the amendments that tried to restore Habeas Corpus if he thought that it was important???

The Constitution is also explicit in that only Congress may declare war, that warrants are necessary for search and seizure, that Congress makes the laws, the judiciary interprets them and that the president's job is to see that they are faithfully executed.
Another point our Constitution is very explicit on is that the President, Vice President and all civil officers of the United States (including members of Congress) shall be impeached and removed from office for the commission of high crimes and misdemeanors.
This Congress continually refuses to stand as one, honor their oath and challenge this president on the blatant UN-Constitutionality of the "Unitary Executive Branch", and the utterly worthless signing statements with which he assigns himself the authority to ignore the laws of our land as he sees fit.
This Congress, by passing the Military Commissions Act of 2006, not only eliminated the 800 year-old great writ of habeas corpus, but also legalized torture, allowing this president to interpret the Geneva Conventions and decide for himself what constitutes this cruel, inhuman, ineffective treatment, and permitted the use of "secret evidence" that defendants are not permitted to review.
This Congress, by completely refusing to hold this president and administration accountable, is not only violating its oath to protect and defend the Constitution, but also making itself criminally complicit in this administration's multitude of crimes against our country and the world.
But you, Mr. Specter, and you, Mr. Leahy, would have us believe that everything will be fine if we simply restore habeas.
Wake up, fools. We're not buying your bullshit anymore.
