Ohhhhh You Mean THAT Kind of "Illegal"

While nobody is even considering prosecuting the violators of the law, Dennis Blair is now in trouble for claiming the the illegal spying was (is) legal. So, Feingold has asked Obama to admit that it isn't:

Feingold Seeks Obama Declaration On Wiretaps

Sen. Russell Feingold, D-Wis., today asked President Obama to declare that it was illegal for the Bush administration to conduct warrantless electronic wiretapping of U.S. citizens. Feingold sent Obama a letter
asking him to renounce legal justifications offered by the previous administration for the surveillance program, which was carried out from 2001-2007. "As a United States senator, you stated clearly and correctly that the warrantless wiretapping program was illegal," Feingold wrote. Feingold said he was making his request in part because of comments made last week by Director of National Intelligence Dennis Blair. In a nationally televised speech, Blair said the surveillance program "wasn't illegal." CongressDaily reported that Blair's office issued a clarification two days later, saying the
director was not making a legal judgment but meant to convey that the surveillance was done in accordance with legal guidance by the Justice Department and pursuant to authorization from the president.

"Nonetheless, Director Blair's remarks -- which directly contravene your earlier position, as well as the position of Attorney General Holder -- risk conveying to the intelligence community, whose job it is to explore legally available surveillance options, that not complying with the Foreign Intelligence Surveillance Act may be such an option," Feingold wrote.
